(7) The obligations extend to Posting Agents as well. If you act as a Posting Agent, or engage one, in violation of the TOU, you agree to pay one hundred dollars ($100) for each infringing item of content posted. Additionally, the principal party that engaged the Posting Agent also assumes responsibility, agreeing to pay another one hundred dollars ($100) for each violating post. These provisions ensure accountability and discourage the use of intermediaries to bypass compliance requirements.

(8) For violations involving the aggregation, display, copying, duplication, reproduction, or other exploitation of content without FindInstruct’s express written permission, the penalties are more substantial. Users who engage in such conduct agree to pay three thousand dollars ($3,000) for each day they persist in these activities. This heightened penalty reflects the seriousness of intellectual property infringement and ensures that violations are met with meaningful consequences.

(9) It is important to note that the liquidated damages specified in these provisions do not limit FindInstruct’s other rights or remedies. The company retains the authority to seek specific performance of the TOU’s terms or to pursue preliminary or permanent injunctions against ongoing or potential breaches. Whether you hire a Professional, rely on their counsel, or enter into a separate agreement with them, FindInstruct shall not be liable for any acts, omissions, negligence, or breach of contract by the Professional or their associates. The responsibility for evaluating a Professional’s credentials, verifying information, and ensuring that any Services performed meet your standards lies solely with you.

For Professionals, your participation in the Programs is also entirely at your own risk. If you do not accept these terms, or if you lack the authority to represent the brand as required, you must refrain from logging in. Your continued use of the account after these terms are presented is taken as an acknowledgment of your legal capacity and agreement to comply.
2. Parties and Electronic Consent: This “Agreement” is formed between “I” or “me” or “the Company” and FindInstruct (collectively, “we” or “the parties”). By proceeding, you consent to conducting this transaction and creating the Agreement by electronic means, ensuring that the mutual understanding between both parties is captured accurately. All rights, obligations, and representations made herein are valid and enforceable to the fullest extent permitted by law.
3. Content License and Accuracy: You hereby grant FindInstruct a non-exclusive, worldwide license to use the images (including logos, product images, installation photos), product catalogues, pricing, and related data (“Content”) that you provide or have placed on your website. FindInstruct may display this Content on its platform and affiliated sites, including social media platforms, picture hosting services, and any channels it deems beneficial for exposure. Although you may suggest how best to present your products or Content, final discretion rests with FindInstruct. You represent and warrant that you have secured all necessary rights to grant this license, that the Content is accurate and representative of your products, and that you will promptly update your FindInstruct account to keep all Content current. FindInstruct and its affiliated sites bear no responsibility for damages associated with the Content or how it is interpreted.
4. Membership and Fees: Membership fees are as stated on FindInstruct at the time of your purchase. The price will remain locked in as long as your membership is current. Payments are due upfront at the start of each 30-day billing cycle for monthly memberships or at the start of each 365-day billing cycle for annual memberships. Unless you cancel your account, fees are automatically deducted from the account on file each billing period. These financial arrangements ensure a smooth and predictable billing process, allowing you continuous access to the features and benefits provided.
5. Contract Duration and Renewal: This Agreement remains valid and in full force until such time as you cancel your account or until otherwise terminated by FindInstruct. By keeping your membership current and meeting your payment obligations, you maintain uninterrupted access to the services and associated benefits. Once your membership is canceled or terminated, the Agreement’s provisions that need to survive will continue to do so as applicable.
6. Billing and Payment Methods: In the event that a payment is due and the credit card information on file is invalid or inactive, FindInstruct will attempt to contact you to update your billing details. A 30-day grace period will be observed before membership cancellation is processed. This approach offers you a reasonable window to rectify payment issues and retain uninterrupted service, ensuring fairness and flexibility in handling billing matters.
7. Termination by Either Party: You may request termination of this Agreement at any time. The termination will take effect at the end of your current billing cycle. Likewise, FindInstruct may terminate this Agreement at will. Should FindInstruct choose to terminate early, and you are not in violation of any terms, you will receive a prorated reimbursement for the unused portion of that billing cycle. This balanced approach ensures that both parties can discontinue the relationship without undue hardship or unfairness.
8. Effect of Termination: Upon termination, whether initiated by you or FindInstruct, your access to the membership services and related features will end. Content you have provided may be retained, modified, or removed in accordance with FindInstruct’s Terms of Use and policies. Additionally, any licenses granted to FindInstruct related to your Content may continue as allowed by the Agreement’s terms. These measures protect the platform’s continuity while respecting your rights and previously established obligations.

Limitations of Liability and Warranties: Nothing in this Agreement shall be construed as a guarantee of specific results or business outcomes from using FindInstruct’s platform and affiliated sites. 24. INTENSIVE COURSE DEPOSIT

(1) This Intensive Course Deposit Agreement ("Agreement") is formed between the student (“I,” “me,” or “Student”) enrolling in an intensive driving course and FindInstruct (“FindInstruct”). By agreeing to these terms, both parties (“we” or “the parties”) consent to conducting this transaction electronically, thereby creating a binding relationship. The Agreement’s purpose is to clarify the rights, obligations, and procedures related to the deposit payment, instructor allocation, and other essential aspects of the intensive driving course experience.

(2) To secure a driving test date and instructor, the Student must pay a fully refundable deposit, the amount of which varies based on the chosen intensive course package. Until FindInstruct allocates both a test date and an instructor, this deposit remains refundable upon the Student’s request. However, once the instructor and test date have been allocated, the deposit becomes non-refundable to ensure the Student’s committed engagement with the course. All deposit payments must be made through Stripe’s secure payment gateway, ensuring a safe and transparent transaction.

(3) The deposit’s flexibility is a key feature of this Agreement. If allocation of the driving test date and instructor has not yet occurred, the Student may request a full refund of the deposit. Likewise, if the course is canceled by the instructor or by FindInstruct before allocation, the deposit is fully refunded to the Student. These refund provisions safeguard both the Student’s interests and the integrity of the scheduling process.

(4) FindInstruct commits to assigning an instructor and finalizing course arrangements within 48 hours of deposit payment. Once allocation is complete, the deposit becomes non-refundable as it serves as a guarantee of the Student’s place in the course. This arrangement protects both the pupil, who secures a reliable instructor and guaranteed test date, and the instructor, who can schedule lessons confidently.

(5) Upon successful completion of the intensive driving course, the deposit previously withheld will be transferred to the instructor as part of their payment. This system is designed to ensure fairness and prevent misuse of the service, reinforcing the value of the Student’s commitment and the instructor’s professional time and skill. By structuring payments in this way, FindInstruct creates a balanced and incentive-driven arrangement that benefits all parties involved.

(6) The Student bears certain responsibilities under this Agreement. They must provide accurate and complete information during registration, including a valid UK provisional driving license. The Student agrees to follow the instructor’s guidance and instructions throughout the course. Compliance with these obligations ensures a constructive learning environment and enables the instructor to tailor lessons effectively.

(7) Beyond the initial deposit, the Student is responsible for paying the remaining balance of the course fee directly to the assigned instructor at the start of the course. This final amount depends on the chosen package, ensuring that Students pay only for the services they select. By handling final payments at the course’s commencement, the Agreement ensures that financial arrangements are transparent and straightforward.

(8) Cancellation and termination rights are also clearly defined. The Student may terminate this Agreement before the allocation of the test date and instructor to receive a full refund of the deposit. However, if the Student opts to cancel after allocation, the deposit is non-refundable.
